1. Use of the Platform

a. Eligibility: You must be at least 18 years old to use the Platform. If you are using the Platform on behalf of a minor, you represent and warrant that you have the legal authority to do so. By accessing the Platform, you confirm that you are eligible to use the Platform in accordance with these Terms.

b. User Accounts: To access certain features of the Platform, you may need to create a user account. You agree to provide accurate and complete information during the registration process and to keep your account credentials secure. You are solely responsible for all activities that occur under your account.

c. User Conduct: You agree to use the Platform in compliance with applicable laws, regulations, and these Terms. You will not engage in any activity that interferes with or disrupts the Platform’s operation, compromises its security, or infringes upon the rights of other users.

2. Services

a. Arrangement of Transportation and In-Ride Care: The Platform facilitates the arrangement of transportation and associated in-ride care services for minors and eligible riders. Stork does not provide transportation services and is not a transportation company. Users are solely responsible for their interactions and agreements with other users. Stork does not endorse or guarantee the quality, safety, or legality of the services provided by users.

b. User Responsibilities: Users agree to provide accurate and complete information when using the Platform. Users will comply with all applicable laws and regulations, including those related to child safety, privacy, and transportation. Users will treat each other with respect and maintain a safe and appropriate environment during transportation and in-ride care services.

3. Privacy and Data Protection

a. Data Collection: Stork may collect and process personal information in accordance with its Privacy Policy. By using the Platform, you consent to the collection, processing, and storage of your personal information as described in the Privacy Policy.

b. Confidentiality: Users agree to keep any confidential information shared through the Platform confidential and not to disclose it to third parties without proper authorization.

4. Intellectual Property

a. Ownership: The Platform and its content, including but not limited to software, designs, trademarks, and logos, are owned by Stork or its licensors and are protected by intellectual property laws. Users agree not to modify, reproduce, distribute, or create derivative works based on the Platform without Stork’s prior written permission.

5. Limitation of Liability

a. Disclaimer: Stork provides the Platform on an “as is” and “as available” basis, without warranties of any kind, express or implied. Stork does not warrant that the Platform will be error-free, secure, or uninterrupted. Users acknowledge and agree that the use of the Platform is at their own risk.

b. Limitation of Liability: In no event shall Stork, its affiliates, or its directors, officers, employees, or agents be liable for any indirect, consequential, incidental, special, or punitive damages arising out of or in connection with the use of the Platform or the services provided by users, even if advised of the possibility of such damages.

6. Termination

a. Termination by Stork: Stork may terminate or suspend your access to the Platform at any time, without prior notice, for any reason or no reason, including if you violate these Terms or engage in any unauthorized use of the Platform.

b. Termination by User: Users may terminate their account and stop using the Platform at any time.

7. Governing Law and Dispute Resolution

a. Governing Law: These Terms are governed by and construed in accordance with the laws of the jurisdiction where Stork is incorporated, without regard to its conflict of laws principles.

b. Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the designated arbitration authority.
